AB 1466 - Restraint & Seclusion Data
On October 8, 2023, Governor Newsom signed Assembly Bill 1466 into law. This legislation aims to enhance transparency by providing the public with easier access to information regarding the use of restraint and seclusion in schools. It requires all local educational agencies (LEAs) to post on their websites the same data they are currently obligated to share annually with the California Department of Education (CDE) regarding student behavior management practices.
What Does AB 1466 Add to Existing Law?
Currently, state law limits the use of restraint and seclusion by school personnel. Additionally, it mandates that LEAs annually collect and report specific data about these practices to the CDE. Under California Education Code section 49006, LEAs must submit a report to the CDE no later than three months after the end of each school year. This report must break down the data by race, ethnicity, and gender, and include separate counts for students with Section 504 plans and Individualized Education Programs (IEPs), as well as those without such plans.
